This Privacy Policy describes how Jackery Australia Pty Ltd (ACN 626 066 902) (“Jackery”, we”, us and our”) collects, stores, uses and discloses information from and about individuals outside our organisation with whom we interact, including customers, visitors to any website operated, or maintained, by us or on our behalf (our “Sites”), or recipients of any of our other services, personnel of corporate customers and visitors to our premises (together, “you”).

This Privacy Policy may be amended or updated from time to time to reflect changes in our practices with respect to the collection, storage, use and disclosure of personal information or changes in applicable law. We encourage you to read this Privacy Policy carefully, and to regularly check this page to review any changes we might make in accordance with the terms of this Privacy Policy.

(B) What personal information do we collect and handle?

Personal information is any information or opinion (whether true or not, and whether recorded in a material form or not) about you as an identified individual, or an individual who is reasonably identifiable.

The types of personal information we collect and handle may include, but are not limited to:

● Personal details: given name(s); and preferred name.
● Demographic information: gender; date of birth / age; salutation; title; and language preferences.
● Contact details: address; telephone number; email address; details of personal assistants, where applicable; messenger app details; online messaging details; and social media details.
● Consent records: records of any consents you have given, together with the date and time, means of consent and any related information (e.g., the subject matter of the consent).
● Purchase details: order information including records of purchases and prices; consignee name; address; contact telephone number; reference numbers; email address; details of returns; and warranty details.
● Data relating to our Sites: device type; operating system; browser type; browser settings; IP address; internet service provider; referring/exit pages; language settings; dates and times of connecting to a Site; usage data, and other technical communications information (some of which may constitute personal information); username; password; security login details; usage data; and aggregate statistical information.
● Content and advertising data: records of your interactions with our online advertising and content, records of advertising and content displayed on pages displayed to you, and any interaction you may have had with such content or advertising (e.g., mouse hover, mouse clicks, any forms you complete in whole or in part) and any touchscreen interactions.
● Views and opinions: any comments, views and opinions that you choose to send to us, or publicly post about us on social media platforms.
● Images and videos of you which are collected by CCTV if you attend our premises.
● Other information: any additional information relating to you that you provide to us directly through our Sites or indirectly through your use of our Sites or through other websites or accounts which you permit us to collect information or any other personal information that may be required in order to facilitate your dealings with us.

    Sensitive information

    We do not seek to collect or otherwise process sensitive personal information in the ordinary course of our business. Where it becomes necessary to process your sensitive personal information for any reason, we rely on one of the following legal bases:

    ● Consent: we may process your sensitive personal information where we have, in accordance with applicable law, obtained your express consent prior to processing your sensitive personal information (this legal basis is only used in relation to processing that is entirely voluntary – it is not used for processing that is necessary or obligatory in any way).
    ● Compliance with applicable law: we may process your sensitive personal information where the processing is required or permitted by applicable law;
    ● Establishment, exercise or defence of legal claims: we may process your sensitive personal information where the processing is necessary for the establishment, exercise or defence of legal claims; or
    ● Detection and prevention of crime: we may process your sensitive personal information where the processing is necessary for the detection or prevention of crime (e.g. the prevention of fraud).

    If you provide sensitive personal information to us, you must ensure that it is lawful for you to disclose such information to us, and you must ensure a valid legal basis applies to the processing of those sensitive personal information.

    (C) How do we collect your personal information?

    We collect personal information through various avenues, including:

    Information you provide to us: we collect personal information when that information is provided by you to us (e.g. when you register an account with us; where you contact us via email or telephone, or by any other means, or when you provide us with your business card, or when you submit a job application).

    Information we obtain in person: we obtain personal information during meetings, at trade shows, during visits from sales or marketing representatives, or at events we attend.

    Collaborations: we obtain personal information when you collaborate with us in research or in an advisory/consultancy capacity.

    Relationship information: we collect or obtain personal information in the ordinary course of our relationship with you (e.g. we provide a service to you, or to your employer).

    Information you make public: we collect or obtain personal information that you choose to make public, including via social media (e.g. we may collect information from your social media profile(s), if you make a public post about us).

    Site information: we collect or obtain personal information when you visit any of our Sites or use any features or resources available on or through a Site.

    ● Registration details: we collect or obtain personal information when you use, or register to use, any of our Sites, or services.
    ● Content and advertising information: if you interact with any third-party content or advertising on a Site (including third party plug-ins and cookies) we receive personal information from the relevant third-party provider of that content or advertising.
    ● Third-party information: we collect or obtain personal information from third-parties who provide it to us (e.g. credit reference agencies; law enforcement authorities; etc.).
    ● CCTV: we collect or obtain personal information (including sensitive information) through our use of CCTV at our premises.

    (D) Why do we collect your personal information?

    We collect, hold, use and disclose your personal information primarily, so that we can provide you with our products and services, and any related information. However, we may also collect your personal information for related reasons, including:

    ● Provision of Sites, and services: providing our Sites, or services; providing promotional items upon request; and communicating with you in relation to those Sites, or services.
    ● Operating our business: operating and managing our Sites, and our services; providing content to you; displaying advertising and other information to you; monitoring and analysing trends, usage, and activities; communicating and interacting with you via our Sites, develop and display content, features, and advertising tailored to your interests on our services as well as on other platforms and services; and notifying you of changes to any of our Sites, or our services.

    ● Recruitment and job applications: recruitment activities; advertising of positions; interview activities; analysis of suitability for the relevant position; records of hiring decisions; offer details; and acceptance details.
    ● Investigations: detecting, investigating and preventing breaches of policy, and criminal offences, in accordance with applicable law.
    ● Legal compliance: compliance with our legal and regulatory obligations under applicable law (including taxation).
    ● Fraud prevention: Detecting, preventing and investigating fraud, breach of policies or terms, and threats or harm.
    ● Establishment, exercise and defence of legal claims: management of legal claims; establishment of facts and claims, including collection, review and production of documents, facts, evidence and witness statements; exercise and defence of legal rights and claims, including formal legal proceedings.
    ● Other purposes: any other purpose which is stated to you at the time of collection or that you otherwise authorise.

    (E) What if we can’t collect your personal information?

    If you do not provide us with the personal information we need, some or all of the following may occur:

    ● we may not be able to provide you with our products or services;
    ● we may not be able to register and create an account with us for you; and
    ● we may not be able to respond to your requests for information.

    You may remain anonymous or to make use of a pseudonym where practicable, however, we may not be able to provide you with some or all of our products or services if you do not identify yourself. For instance, all orders require your actual name to be provided.

    (F) Who might we disclose your personal information to?

    We may disclose your personal information to other entities within the Jackery Group and other third parties, for any of the purposes identified above, including:

    ● our employees, other personnel, related companies and affiliates;
    ● accountants, auditors, consultants, lawyers and other outside professional advisors to Jackery;
    ● third party service providers (such as email service providers; marketing service providers; venue operators; payment services providers; postal carriers);
    ● any relevant third-party acquirer(s) or successor(s) in title, in the event that we sell or transfer all or any relevant portion of our business or assets (including in the event of a reorganization, dissolution or liquidation);
    ● any relevant third-party provider, where our Sites use third-party advertising, plugins or content. If you choose to interact with any such advertising, plugins or content, your personal information may be shared with the relevant third-party provider. We recommend that you review that third party’s privacy policy before interacting with its advertising, plugins or content; and
    ● government agencies, regulatory bodies and law enforcement agencies, as required, authorised or permitted by law.

    We may also disclose your personal information to trusted third parties who hold other information about you. Such a third party may combine that information in order to enable it and us to develop anonymised consumer insights so that we can better understand your preferences and interests, personalise your experience and enhance the products and services that you receive.

    We may disclose your personal information to the following overseas recipients for some of the purposes listed above:

    These recipients may be located overseas including in the USA and China.This may change from time to time, including as a result of change of provider, changes in data protection practices and processing efficiency.

    Cookies

    When you visit a Site, we will typically place cookies onto your device, or read cookies already on your device.     Our Sites may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. The privacy policies that apply to those other websites may differ substantially from our Privacy Policy, so we encourage individuals to read them before using those websites.

    (I) How do we protect your personal information?

    We take all reasonable steps to keep personal information protected from loss, interference, misuse or unauthorised access, modification or disclosure. These steps may include access controls, encryption, desensitisation and secure premises. We store personal information in both physical and electronic form, sometimes with the assistance of third parties such as data hosting providers.

    Because the internet is an open system, the transmission of information via the internet is not completely secure. Although we will implement all reasonable measures to protect your personal information, we cannot guarantee the security of your data transmitted to us using the internet – any such transmission is at your own risk and you are responsible for ensuring that any personal information that you send to us are sent securely.

Please note that it may take up to 2 weeks to process your unsubscribe request during which time you may continue to receive communications from us. After you unsubscribe, we will not send you further promotional emails, but in some circumstances we will continue to contact you to the extent necessary for the purposes of any Sites, or services you have requested.

    We may decline a request for access to or correction of personal information in circumstances prescribed by the Privacy Act 1988 (Cth) ('Privacy Act'), and if we do, we will give you a written notice that sets out the reasons for the refusal (unless it would be unreasonable to provide those reasons), including details of the mechanisms available to you to make a complaint.

    If you wish to make a complaint about a breach of the Privacy Act, the APPs or a privacy code that applies to us, please contact us using the details below and we will take reasonable steps to investigate the complaint and respond to you.
